These Terms and Conditions ("Terms") govern the use of the website landscapejk.com and the real estate crowdlending services provided by Landscapejk S.R.L. By accessing or using our services, you agree to be bound by these Terms.
1. Definitions
"Platform": The website landscapejk.com and all its associated services. "User": Any person who accesses or uses the Platform. "Investor": Registered user who participates in crowdlending opportunities. "Project": Real estate investment opportunity presented on the Platform. "Developer": Company or person presenting real estate projects on the Platform.
2. Eligibility
To use our investment services, you must: be at least 18 years old, have the legal capacity to enter into binding contracts in Bolivia, successfully complete our identity verification (KYC) process, and not be subject to economic sanctions or legal restrictions that prevent you from investing.
3. Nature of Services
Landscapejk operates as a technological intermediary that connects investors with real estate projects. We are not a regulated financial institution nor do we provide investment advice. Investment decisions are the sole responsibility of the user.
4. Investment Risks
WARNING: All investment carries risks, including the possible total loss of invested capital. Past returns do not guarantee future results. Real estate projects may face delays, cost overruns, or failures. Investment liquidity is limited. We recommend investing only money you can afford to lose and diversifying your investments.
5. Investment Process
When investing in a project: You select the project and investment amount. Funds are transferred to an escrow account. Once the funding goal is reached, funds are released to the developer according to the agreed schedule. You will receive periodic updates on the project's progress. Upon project completion, you will receive your capital plus the agreed returns, subject to project success.
6. User Obligations
You agree to: provide truthful and up-to-date information, maintain the confidentiality of your access credentials, not use the platform for illegal activities, comply with all applicable laws including tax regulations, and notify us immediately of any unauthorized use of your account.
7. Intellectual Property
All content on the Platform, including texts, graphics, logos, icons, images, software, and their compilation, is the property of Landscapejk S.R.L. or its licensors and is protected by Bolivian and international intellectual property laws.
8. Limitation of Liability
To the maximum extent permitted by Bolivian law, Landscapejk S.R.L. shall not be liable for: investment losses resulting from user decisions, service interruptions due to causes beyond our control, actions or omissions of developers or third parties, indirect, incidental, or consequential damages.
9. Dispute Resolution
Any dispute related to these Terms shall first be resolved through good faith negotiation. If an agreement is not reached, the parties will submit the dispute to arbitration administered by the Conciliation and Arbitration Center of the Chamber of Commerce of La Paz, Bolivia.
10. Applicable Law
These Terms are governed by the laws of the Plurinational State of Bolivia. The courts of La Paz, Bolivia shall have exclusive jurisdiction for any matter not subject to arbitration.
11. Modifications
We reserve the right to modify these Terms at any time. Changes will take effect upon posting on the Platform. Continued use of our services after any modification constitutes your acceptance of the new Terms.
